Please read these Terms and Conditions of Use ("Terms") carefully before using the online point of sale services provided by Epos Next (operated by Bravo Hosting & Web Services) ("Service"). These Terms constitute a legal agreement between you ("User") and Bravo Hosting & Web Services. 4. Payment and Pricing

4.1. The pricing for the Service is provided on the Epos Next website and is subject to change at any time. You agree to pay the applicable fees for the Service as set forth on the website.

4.2. Payment for the Service is due in advance, and you authorize Bravo Hosting & Web Services to charge your designated payment method for the applicable fees.

5. Limitation of Liability

5.1. Bravo Hosting & Web Services provides the Service on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Bravo Hosting & Web Services does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

5.2. Nothing in these Terms shall exclude or limit Bravo Hosting & Web Services' liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

5.3. Subject to clause 5.2, Bravo Hosting & Web Services shall not be liable for any indirect, consequential, special, or punitive damages arising out of or in connection with the Service or these Terms.

5.4. To the maximum extent permitted by applicable law, Bravo Hosting & Web Services' aggregate liability for any claims related to the Service or these Terms, whether in contract, tort, or otherwise, shall be limited to the fees paid by you for the Service during the three (3) months preceding the claim.

5.5. Bravo Hosting & Web Services shall not be liable for any losses, damages, costs, or expenses incurred by you as a result of: (a) Your use of or reliance on the Service; (b) Any unauthorized access

to or alteration of your transmissions or data; (c) Any content or conduct of any third party on the Service; (d) Any delay or disruption of the Service; or (e) Any other matter relating to the Service.

5.6. You acknowledge and agree that the limitations and exclusions of liability in this Section 5 are reasonable and that without them, Bravo Hosting & Web Services would not be able to provide the Service on the same terms.

6. Termination

6.1. Either party may terminate these Terms at any time by providing written notice to the other party. Upon termination, your access to the Service will be disabled, and you must cease all use of the Service.

6.2. Sections 3, 4, 5, and 7 of these Terms shall survive termination and continue to apply.

7. Miscellaneous

7.1. These Terms constitute the entire agreement between you and Bravo Hosting & Web Services regarding the Service and supersede any prior or contemporaneous agreements, understandings, or representations.

7.2. These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
